These Terms of Service ("Terms") constitute a legally binding agreement between you and TrendyCat ("Company," "we," "us," or "our") concerning your access to and use of the TrendyCat website (trendycat.com) and any related services (collectively, the "Service").

TrendyCat is a YouTube Shorts discovery platform that provides users with tools to find trending channels, analyze metrics, and discover profitable niches. Our Service includes:

• Channel filtering, sorting, and search functionality
• Ability to save and bookmark channels (for authenticated users)
• Premium features available through paid subscription

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. User Accounts

To access certain features of our Service, you must create an account using Google OAuth authentication. You agree to:

• Accept responsibility for all activities that occur under your account

3.2 Account Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Payment and Lifetime Access

4.1 Lifetime Access

TrendyCat offers a one-time payment for lifetime access to all premium features. Once purchased, you will have unlimited access to all current and future features without any recurring charges. Pricing details and features are available on our pricing page.

4.2 Payment Processing

All payments are processed securely through Stripe. By purchasing lifetime access, you authorize us to charge your payment method a one-time fee. Your payment information is never stored on our servers and is handled entirely by Stripe.

4.3 Refunds

• All sales are final. Once lifetime access is granted, no refunds will be provided
• We may offer refunds at our sole discretion on a case-by-case basis
• Refund requests must be submitted within 7 days of purchase through our support channels
• Refunds, if approved, will be processed through the original payment method

4.4 Failed Payments

If a payment fails during checkout, you will not be granted access until the payment is successfully processed. You may retry the payment or contact support for assistance.

5. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Engage in any fraudulent, abusive, or illegal activity
• Scrape, crawl, or harvest data from the Service using automated means
• Reverse engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the Service or servers

6.3 Third-Party Content

YouTube channel data and metrics displayed on our Service are sourced from the YouTube Data API and are subject to YouTube's Terms of Service. We do not claim ownership of this third-party content.

7. YouTube API Services

8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Accuracy of Data

We strive to provide accurate and up-to-date information, but we do not guarantee the accuracy, completeness, or reliability of any data, metrics, or analytics provided through the Service. YouTube data is subject to change and may contain errors or inaccuracies.

8.3 No Guarantee of Results

We do not guarantee that using the Service will result in any specific outcomes, financial gains, or business success. Any business decisions you make based on information from the Service are your sole responsibility.

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDYCAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or other harmful code that may be transmitted through the Service
• Any errors or omissions in any content or data
• Any loss or damage of any kind incurred as a result of your use of any content posted or transmitted through the Service

IN NO EVENT SHALL TRENDYCAT'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO TRENDYCAT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR $100 USD, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless TrendyCat, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit to the Service

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

10.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

10.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

11. Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Requests by law enforcement or government agencies

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnification, and limitations of liability.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrendyCat regarding the use of the Service, superseding any prior agreements between you and TrendyCat.

14. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by TrendyCat.

15. Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice or consent.
